Terms of Service

1. Acceptance of Terms

By accessing or using the Dishy mobile application ("App") and any related websites or services (together, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Description of Service

Dishy is a food-discovery platform that helps users find dishes and restaurants based on their search query, preferences, dietary restrictions, and location. Recommendations are generated using a combination of public data and third-party AI services. The Services include:

  • Personalized dish and restaurant recommendations.
  • Search and discovery based on menu items and reviews.
  • User-submitted ratings, reviews, and photos.
  • Dietary and allergen filtering.

3. Eligibility

You must be at least 13 years old to use the Services. If you are between 13 and the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the Services.

4. User Accounts

To use certain features you must create an account. You agree to:

  • Provide accurate and complete information.
  • Keep your account credentials secure and confidential.
  • Notify us promptly of any unauthorized use of your account.
  • Be responsible for all activity that occurs under your account.

We may close or suspend accounts that violate these Terms or that we reasonably believe pose a risk to other users or to Dishy.

5. User Content

You may submit ratings, reviews, photos, and other content ("User Content"). You retain ownership of your User Content. By submitting User Content, you:

  • Grant Dishy a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, distribute, modify (for example, to resize images), and use your User Content for the purpose of operating, improving, and promoting the Services.
  • Represent that you own or have all necessary rights to submit it, and that it does not violate the rights of any third party.
  • Agree it does not contain unlawful, defamatory, harassing, infringing, hateful, or otherwise objectionable material.

We may remove User Content at any time, with or without notice, if we determine in good faith that it violates these Terms or applicable law.

6. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms.
  • Submit false, misleading, or impersonating information.
  • Harass, threaten, abuse, or harm other users.
  • Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Services or related systems.
  • Use automated means (scrapers, bots, crawlers) to access the Services or extract data, except as expressly permitted by us in writing.
  • Reverse-engineer, decompile, or attempt to derive source code from the Services, except where applicable law expressly permits.
  • Circumvent or attempt to circumvent any rate limits, security controls, or access restrictions.
  • Use the Services to train machine-learning or generative-AI models without our prior written permission.

7. Intellectual Property

The Services, including all software, design, text, graphics, logos, and trademarks, are owned by Dishy or its licensors and are protected by intellectual-property laws. Except for the limited license granted to you to use the Services in accordance with these Terms, no rights are transferred to you. You may not copy, modify, distribute, sell, or create derivative works of any part of the Services without our prior written permission.

8. Third-Party Services

The Services include integrations with third-party providers (for example, Google Maps and AI services from OpenAI and Perplexity). The Services may also contain links to third-party websites. We do not control, endorse, or assume responsibility for the content, privacy practices, or behavior of third-party services. Your use of any third-party service is governed by its own terms.

9. AI-Generated Content

Some content in the Services — including dish recommendations, descriptions, and ratings summaries — is generated by automated systems including large-language-model services. AI-generated content can be inaccurate, incomplete, or out of date. Dishy does not guarantee the accuracy of any AI-generated content. You should always verify menus, prices, hours, ingredients, allergen information, and availability directly with the restaurant before relying on them, especially for medical, dietary, or allergy-related decisions.

10. Disclaimer of Warranties

THE SERVICES AND ALL CONTENT WITHIN THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, RESTAURANT INFORMATION (INCLUDING MENU ITEMS, PRICES, HOURS, AND AVAILABILITY) AND USER REVIEWS AND PHOTOS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT BE CURRENT OR ACCURATE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISHY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, OR PERSONAL INJURY, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF DISHY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL DISHY'S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO DISHY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Dishy and its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination (including User Content license, intellectual-property, disclaimers, limitation of liability, indemnification, and dispute-resolution provisions) will survive.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-laws provisions. Subject to Section 15, any dispute arising under or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.

15. Dispute Resolution

We hope to resolve any dispute informally. Before filing a claim, please contact us at support@dishyai.com and describe the issue; we will work in good faith to resolve it. If we cannot resolve a dispute informally within 60 days, either party may pursue formal legal remedies as permitted by these Terms and applicable law.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on our website and in the App and update the "Last updated" date above. If the changes are material, we will provide additional notice. Your continued use of the Services after the update constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Services.

17. Miscellaneous

These Terms (together with the Privacy Policy) are the entire agreement between you and Dishy regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision does not waive that right or provision. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
